The owners/applicants, after having their permit application denied by Charlotte County's hearing officer, have applied for relief under Florida Statute

70.51

"Environmental and Land Use Resolution Act" a part of the Bert Harris Act.  Our (homeowners) attorney has therefore filed a lawsuit challenging the Act alleging that it is unconstitutional and does not give us, the homeowners, our due process.  If you read through the Act you'll see why he/we have chosen to "go down this road"; incidently our county is in aggreement with us and their position is the support the denial of their hearing officer.  The "special magistrate/master"

presiding over the arbitration between the county and owners will give us his decision within 14 days.  I'll keep you updated as best I can and forward whatever documents I can.
